Terms of Service

The rules for using HypeTally — accounts, billing, overlays, API keys, and community designs.

1. Agreement

By creating an account or using HypeTally (“Service”), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.

HypeTally uses YouTube API Services. By using HypeTally, you also agree to be bound by the YouTube Terms of Service.

2. The Service

HypeTally helps creators display live YouTube like counts and member tickers as OBS browser-source overlays. Features may include dashboard configuration, quota-aware polling, custom overlay HTML, community designs, and paid plan access for live polling.

We may change, suspend, or discontinue features with reasonable notice when practical. The Service depends on third parties (including YouTube, Supabase, and Stripe) and may be unavailable when those providers or your own API quota limits access.

3. Accounts

You must provide a valid email and keep your login credentials secure. You are responsible for activity under your account. Notify us promptly if you suspect unauthorized access.

4. YouTube API Services

HypeTally is an API Client that uses YouTube API Services (YouTube Data API v3) to retrieve like counts and new-member events for the video and live chat IDs you configure. You supply your own YouTube Data API key from Google Cloud. You are responsible for:

  • Complying with the YouTube Terms of Service, YouTube API Services Terms of Service, and YouTube API Services Developer Policies
  • Complying with Google Cloud / API quotas and securing and restricting your API key
  • Using only channels, videos, live chats, and data you are authorized to access — typically your own content
  • Not using HypeTally to circumvent YouTube restrictions, harvest viewer data, or violate YouTube Community Guidelines
  • Not creating multiple Google Cloud projects to artificially increase quota for the same use case (“quota sharding”)

Like counts shown in HypeTally come from YouTube API Data. Progress toward a like goal is a simple comparison of that YouTube like count to a goal you set in HypeTally — not a separate YouTube metric. We do not invent or replace YouTube statistics with independently calculated substitutes.

HypeTally is not affiliated with, endorsed by, or sponsored by YouTube or Google. YouTube is a trademark of Google LLC.

5. Subscriptions and billing

Paid plans unlock live polling and related features described at signup or in the dashboard. Payments are processed by Stripe. Prices, plan names, and availability may change; changes to recurring plans generally apply on the next billing cycle unless stated otherwise.

You can manage or cancel through the Stripe billing portal linked from the dashboard. Unless required by law, fees already charged are non-refundable. Access may end when a subscription lapses or payment fails.

6. Overlays and public URLs

Overlay URLs are meant to be loaded by OBS. Anyone with the URL may be able to view the overlay. Do not place secrets, private keys, or sensitive personal data in overlay HTML or community designs.

7. Custom HTML and community designs

If you upload or save custom HTML, or publish designs to the gallery, you represent that you have the rights to that content and that it does not include malware, phishing, illegal material, or content that infringes others’ rights.

By publishing a community design, you grant HypeTally a non-exclusive, worldwide license to host, display, and let other users apply that design within the Service. You may request removal of designs you own; we may also remove designs that violate these Terms.

8. Acceptable use

You agree not to:

  • Abuse, disrupt, or reverse engineer the Service beyond permitted use
  • Attempt to access other users’ accounts, keys, or private data
  • Use the Service to violate YouTube, Google, or other third-party terms or policies
  • Use YouTube API Data from HypeTally to build rival rankings, scrape channels at scale, or derive prohibited analytics about YouTube’s business
  • Upload harmful scripts or content intended to compromise viewers or the platform
  • Resell or misuse the Service in a way that harms HypeTally or other creators

9. Intellectual property

HypeTally branding, product UI, and our own code remain ours or our licensors’. Your account content (such as your custom overlay HTML and designs you create) remains yours, subject to the licenses needed to operate the Service.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee uninterrupted polling, accurate third-party counts, or that overlays will work with every OBS setup or YouTube change.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, HYPETALLY AND ITS OPERATORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, GOODWILL, DATA, OR STREAM REVENUE. OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE MONTHS BEFORE THE CLAIM.

12. Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms, abuse the Service, fail to pay, or if we need to do so for security or legal reasons.

13. Changes to these Terms

We may update these Terms. The “Last updated” date will change when we do. Continued use after changes become effective constitutes acceptance of the updated Terms.
