1. Agreement
These Terms of Service are between you and QuadBit LLC (“QuadBit”, “we”, “us”, or “our”). HypeTally is a product operated by QuadBit. By creating an account or using HypeTally (the “Service”), you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
HypeTally uses YouTube API Services. By using HypeTally, you also agree to be bound by the YouTube Terms of Service.
2. The Service
HypeTally helps creators display live stream stats, alerts, and interactive overlays as OBS browser sources. Depending on your configuration, the Service may include:
- YouTube overlays — likes, members, subscribers, members roster, and live chat (via API key or YouTube OAuth)
- Twitch overlays — subscriptions, followers, bits, raids, hype train, and related counters
- Discord voice queue and on-air timer overlays for call-in streams
- Viewer donations — hosted donate pages, alerts, tickers, and leaderboards through Stripe Connect
- A visual overlay editor, custom HTML, uploaded fonts and media, and community designs
- A Windows OBS multistream plugin (subscriber-only) for dual-platform streaming where enabled
- Dashboard configuration, quota-aware polling, and paid plan access for live features
We may change, suspend, or discontinue features with reasonable notice when practical. The Service depends on third parties (including YouTube, Google, Twitch, Discord, Supabase, and Stripe) and may be unavailable when those providers, your API quota, or your connection settings limit access.
3. Accounts
You must provide a valid email and keep your login credentials secure. You may sign up with email and password or, where offered, Google account sign-in through our auth provider. You are responsible for activity under your account. Notify us promptly if you suspect unauthorized access.
4. YouTube
HypeTally uses YouTube API Services (YouTube Data API v3) and, where you enable it, YouTube OAuth to retrieve data for the channels, videos, and live chats you configure — including like counts, subscriber counts, new-member events, and live chat when supported. You may connect YouTube with your own Google Cloud API key or through YouTube OAuth in the dashboard. You are responsible for:
- Complying with the YouTube Terms of Service, YouTube API Services Terms of Service, and YouTube API Services Developer Policies
- Complying with Google Cloud / API quotas and securing and restricting your API key
- Using only channels, videos, live chats, and data you are authorized to access — typically your own content
- Not using HypeTally to circumvent YouTube restrictions, harvest viewer data, or violate YouTube Community Guidelines
- Not creating multiple Google Cloud projects to artificially increase quota for the same use case (“quota sharding”)
Like counts and subscriber counts shown in HypeTally come from YouTube API Data where applicable. Overlay goal percentages (for example likes toward a like goal) and optional “session gain” counters are HypeTally calculations, not YouTube metrics. When session gain is enabled, HypeTally still displays the official YouTube subscriber count alongside that HypeTally figure. Members roster overlays may use a CSV export you upload from YouTube Studio; you represent that you have the right to use that data on stream.
Some chat features may use alternative capture methods you enable (such as a browser extension or server-side relay) in addition to or instead of YouTube API polling. You are responsible for using those features only on streams and chats you are authorized to display.

5. Twitch
If you connect Twitch, HypeTally uses Twitch OAuth and the Twitch API (including EventSub where configured) to retrieve data for your channel — such as subscription, follower, bits, raid, and hype train information for overlays you enable. You are responsible for complying with Twitch’s Terms of Service and Twitch’s Developer Agreement, and for connecting only channels you are authorized to manage.

6. Discord
If you link a Discord server, you authorize the HypeTally bot to access the guild, channels, and roles you select so we can show voice queue and on-air overlays and related dashboard features. You are responsible for moderating your Discord server, granting appropriate permissions, and complying with Discord’s Terms of Service and Discord’s Developer Terms.
Optional support features may let you verify a Discord account with HypeTally for support tickets. Discord is a trademark of Discord Inc.
7. Subscriptions and billing
Paid plans unlock live polling, overlays, the visual editor, multistream access (where available), community design publishing, and other features shown as active in the dashboard. We may offer Standard and Friends pricing tiers; eligible accounts are assigned Friends pricing by us. Payments are processed by Stripe. Prices, plan names, and availability may change; changes to recurring plans generally apply on the next billing cycle unless stated otherwise.
Free trial. New creator accounts may receive a free trial with full access to paid features. Unless we state otherwise at signup, the trial is currently 7 days and does not require a payment method to start. Trial length, eligibility, and availability may change; the period shown when you create your account or on our website at signup applies to you. Support-granted trials may use a different length.
During a trial, you can use the Service like a paying subscriber. Before the trial ends, you may add a payment method through the Stripe billing portal linked from the dashboard. If you do not add a payment method, your trial subscription may automatically cancel at the end of the trial period and paid features may lock until you subscribe. Free trials are limited to one per account unless we explicitly grant another trial (for example through admin support).
You can manage or cancel through the Stripe billing portal linked from the dashboard. Unless required by law, fees already charged are non-refundable. Access may end when a subscription lapses, a trial ends without payment, or payment fails.
Viewer tips are separate from your HypeTally subscription. If you enable donations, you must complete Stripe Connect onboarding and comply with Stripe’s terms and applicable payment laws. HypeTally may charge a platform fee on donations (shown in the dashboard and on donate pages). You may choose whether the platform fee is paid by you or added for the donor where that option is offered. Payouts go to your connected Stripe account; HypeTally is not responsible for tax reporting or chargebacks on viewer donations.
8. Overlays and public URLs
Overlay URLs are meant to be loaded by OBS or similar broadcast software. Anyone with the URL may be able to view the overlay and the live data it displays — including like and subscriber counts, member or roster names, Twitch stats, Discord queue state, recent chat messages, and donation alerts with donor-chosen display names or messages (subject to your moderation settings). Do not place secrets, private keys, or sensitive personal data in overlay HTML, uploaded assets, or community designs.
9. Custom HTML, editor content, and community designs
If you upload or save custom HTML, use the visual overlay editor, upload fonts or media, or publish designs to the gallery, you represent that you have the rights to that content and that it does not include malware, phishing, illegal material, or content that infringes others’ rights.
Publishing a community design generally requires an active subscription. By publishing, you grant QuadBit a non-exclusive, worldwide license to host, display, and let other users apply that design within the Service. You may request removal of designs you own; we may also remove designs that violate these Terms.
The dashboard may offer copyable AI prompts for use with third-party AI tools you choose. HypeTally does not send your overlay data to those providers; if you paste content into an external AI service, you are responsible for that service’s terms and privacy practices.
10. Multistream and desktop plugin
Where available, HypeTally may offer a Windows OBS plugin that links to your account through OAuth and can send streams to platforms you configure (such as YouTube and Twitch). You are responsible for complying with each platform’s multistream, simulcast, and content policies. Plugin availability, supported platforms, and system requirements may change.
11. Acceptable use
You agree not to:
- Abuse, disrupt, or reverse engineer the Service beyond permitted use
- Attempt to access other users’ accounts, keys, tokens, or private data
- Use the Service to violate YouTube, Google, Twitch, Discord, Stripe, or other third-party terms or policies
- Use YouTube or Twitch data from HypeTally to build rival rankings, scrape channels at scale, or derive prohibited analytics about those platforms’ businesses
- Use chat capture tools or overlays to harvest unrelated viewers’ data or display chat you are not authorized to show
- Upload harmful scripts or content intended to compromise viewers or the platform
- Circumvent donation message moderation or abuse viewer payment flows
- Resell or misuse the Service in a way that harms QuadBit, HypeTally, or other creators
12. Intellectual property
HypeTally branding, product UI, and our own code remain QuadBit’s or our licensors’. Your account content (such as your custom overlay HTML and designs you create) remains yours, subject to the licenses needed to operate the Service.
13. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee uninterrupted polling, accurate third-party counts, chat capture, multistream plugin compatibility, or that overlays will work with every OBS setup or third-party API change.
14. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, QUADBIT LLC WILL NOT BE LIABLE FOR INDIRECT, FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, GOODWILL, DATA, OR STREAM REVENUE. OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE MONTHS BEFORE THE CLAIM.
15. Termination
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms, abuse the Service, fail to pay, or if we need to do so for security or legal reasons.
16. Changes to these Terms
We may update these Terms. The “Last updated” date will change when we do. Continued use after changes become effective constitutes acceptance of the updated Terms.
